Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you" or "User") and Cosmos ("Cosmos," "we," "us," or "our"), the operator of the website located at try-cosmos.com and the related services, applications, and content we provide (collectively, the "Service"). Please read these Terms carefully. By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Risk Disclosure, and Cookie Policy, each of which is incorporated herein by reference. If you do not agree, you must not access or use the Service.

1. Eligibility

You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction if higher, to use the Service. By using the Service, you represent and warrant that: (a) you meet this age requirement; (b) you have the legal capacity to enter into these Terms; (c) you are not a person barred from receiving the Service under the laws of any applicable jurisdiction; and (d) your access to and use of the Service does not violate any law or regulation applicable to you. You are solely responsible for determining whether your use of the Service, and of any third-party platform referenced by the Service, is lawful in your jurisdiction.

2. Description of the Service

Cosmos is an analytics and information tool. The Service applies algorithms, heuristics, and statistical models to publicly available, on-chain trading activity from the Polymarket prediction-market platform in order to identify and score trading patterns that may be consistent with informed or "smart-money" behavior. The Service presents these observations, scores, and related data for informational and educational purposes only.

Cosmos is an independent product. It is not affiliated with, endorsed by, sponsored by, or operated by Polymarket or any of its affiliates. The Service does not execute trades, hold or transmit funds, custody assets, or provide access to any prediction market.

3. No Financial, Investment, Legal, or Tax Advice

The Service, including all signals, scores, labels, narratives, historical records, and other content, does not constitute financial, investment, trading, legal, accounting, or tax advice, and must not be relied upon as such. Cosmos is not a broker, dealer, exchange, investment adviser, financial adviser, or fiduciary, and no content provided through the Service is a recommendation, solicitation, or offer to buy, sell, or hold any position, asset, token, or instrument. You are solely responsible for your own decisions and for any losses you may incur. You should seek the advice of independent, licensed professionals before making any decision. 4. Accounts and Onboarding

To access certain features, you must create an account by signing in through a supported third-party identity provider (e.g., Google) and by submitting a link to your public Polymarket profile. Account access is subject to review and approval at our sole discretion, and we may grant, delay, condition, or deny access for any lawful reason.

You agree that:

• all information you provide is accurate, current, and complete, and you will keep it up to date;
• you are responsible for maintaining the confidentiality of, and all activity that occurs under, your account;
• you will not impersonate any person or entity or misrepresent your affiliation with any person or entity; and
• you will promptly notify us of any unauthorized use of your account.

5. Polymarket and Other Third-Party Services

The Service analyzes data relating to, and may contain links to, third-party platforms and services, including Polymarket and the partner offers featured on our Partnerships page. We do not control and are not responsible for any third-party platform, its availability, content, terms, fees, or practices, or for any data it makes available. Your use of any third-party service is governed solely by that third party's terms and policies, and is entirely at your own risk. References to a third party do not imply our endorsement of it.

6. Affiliate Relationships

Cosmos is provided free of charge to Users. We may earn compensation through affiliate or referral arrangements when you open an account with, sign up for, or transact with a third party through links we provide (including Polymarket and the brands on our Partnerships page). This compensation helps fund the Service and does not increase the price you pay. Affiliate relationships do not alter our analysis or the content we present.

7. Referral Program ("Golden Events")

We may offer a referral program through which you can unlock additional Service features (such as premium "Golden Event" signals) by inviting other people to join Cosmos. The program is subject to the following terms, in addition to any rules we publish in-product:

• No cash value. Referral rewards consist solely of access to features. They carry no monetary value, are not redeemable for cash, and are non-transferable.
• Valid referrals. A referral counts toward an unlock only if the referred person is a genuine, distinct individual who completes the required onboarding steps and is approved by us. We determine in our sole discretion whether a referral is valid.
• Anti-fraud. Self-referrals, and referrals associated with the same device, IP address, or otherwise indicative of duplicate, automated, or fraudulent activity, may be flagged, will not count toward your unlock by default, and may be reviewed by us. We may require additional verification.
• Prohibited conduct. You may not buy, sell, trade, spam, incentivize through deception, or otherwise artificially generate referrals or sign-ups.
• Our decisions are final. Approval, rejection, and validity decisions are made at our sole discretion and are final. Abuse of the program may result in the loss of rewards and the suspension or termination of your account.
• Changes. We may modify, suspend, or discontinue the referral program, or change its thresholds and rewards, at any time without liability to you.

8. Acceptable Use

You agree that you will not, and will not attempt to:

• access, scrape, harvest, copy, or index the Service or its data by automated means, or resell, redistribute, or commercially exploit the Service or its content without our prior written consent;
• circumvent, disable, or interfere with security, fraud-prevention, or access-control features, including device or IP-based controls;
• reverse engineer, decompile, or attempt to derive the source code or underlying models of the Service, except to the extent permitted by applicable law;
• introduce malware, conduct denial-of-service attacks, or otherwise disrupt or impair the integrity or performance of the Service;
• use the Service to harass, defame, or violate the rights of any person, or to make unlawful accusations against any individual; or
• use the Service in violation of any applicable law, regulation, or third-party terms.

9. Intellectual Property

The Service and all content, software, models, text, graphics, logos, and designs we provide (excluding third-party and User-provided content) are owned by Cosmos or its licensors and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own non-commercial purposes. All rights not expressly granted are reserved. "Cosmos," our logo, and try-cosmos.com are our marks and may not be used without our prior written permission.

10. User Submissions

You retain ownership of information you submit to us (such as your Polymarket profile link). You grant Cosmos a worldwide, royalty-free, non-exclusive license to host, store, process, and use such information as necessary to operate, provide, secure, and improve the Service and as described in our Privacy Policy. You represent that you have the right to submit such information and that it does not violate any law or third-party right.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, COSMOS DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY SIGNAL, SCORE, OR DATA IS ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR SECURE. ANY RELIANCE ON THE SERVICE IS AT YOUR OWN RISK.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL COSMOS OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR TRADING OR INVESTMENT LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (WHICH, FOR A FREE SERVICE, MAY BE ZERO) OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify, defend, and hold harmless Cosmos and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; or (d) any decision you make in reliance on the Service.

14. Suspension and Termination

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, including if we believe you have violated these Terms, engaged in fraudulent or abusive conduct (including referral abuse), or created risk or legal exposure for us. You may stop using the Service at any time. Upon termination, the licenses granted to you cease, and Sections that by their nature should survive (including Sections 3, 9, 11, 12, 13, 16, and 17) will survive.

15. Changes to the Service and These Terms

We may modify, suspend, or discontinue all or part of the Service at any time. We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

16. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. Subject to applicable mandatory consumer-protection laws, you agree that the competent courts of Tel Aviv-Yafo, Israel will have exclusive jurisdiction, and you consent to their personal jurisdiction and venue. To the extent permitted by law, any claim must be brought on an individual basis and not as part of a class or representative action.

17. Miscellaneous

These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and Cosmos regarding the Service. If any provision is held unenforceable, the remaining provisions will remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them freely. We are not liable for any failure or delay caused by events beyond our reasonable control.
